Terms of Service
Terms for all SafeHaven services: obligations, equipment, liability, termination.
These terms apply to all SafeHaven services (executive protection, uniformed guarding, event security, CCTV, alarms, cybersecurity, IT, investigations, surveillance, background checks and digital forensics) unless a signed agreement states otherwise. If they conflict, the signed agreement prevails.
- Formation. An engagement is confirmed by a signed service agreement or a purchase order accepted in writing and, where applicable, payment of the deposit.
- Scope. Services, sites, schedules, staffing and deliverables are set out in the agreement. Additions are billed at our current rates.
- SafeHaven's obligations. Provide officers who hold a valid provincial licence and are trained and insured; act diligently and lawfully; keep the engagement confidential.
- Client's obligations. Provide accurate and complete information, safe site access, and disclose known risks. The client may not request any unlawful act (trespass, illegal interception, pretexting, unjustified use of force).
- Reasonable efforts. SafeHaven takes reasonable measures but does not guarantee the absence of theft, damage or injury, or any specific investigative outcome.
- Equipment. Equipment supplied by SafeHaven (radios, cameras, panels, loaned gear) remains our property until paid in full, or at all times if loaned. It must be returned in good condition at the end of the engagement; missing or damaged items are billed at replacement cost.
- CCTV and alarm installations. 12-month labour warranty; hardware is covered by the manufacturer's warranty.
- Non-solicitation. During the engagement and for 12 months after, the client will not directly hire an officer assigned to its engagement without SafeHaven's written consent. Otherwise a placement fee of a variable amount applies.
- Liability. Except for gross or intentional fault, SafeHaven's total liability is limited to the amount paid for the service in question over the previous 12 months. SafeHaven carries over $2,000,000 commercial general liability insurance.
- Force majeure. Neither party is liable for delays caused by events beyond its control (disaster, pandemic, government order, major outage).
- Termination. Either party may terminate on written notice under the Refund & Cancellation Policy, or immediately for a material breach not cured within 10 days.
- Investigation reports. Reports are for the client only and must be used lawfully. SafeHaven may decline or stop any engagement that appears unlawful or likely to harm others.
- Consumers. For individual clients, their provincial consumer protection laws apply and prevail over any inconsistent clause.
- Governing law. Laws of Ontario and applicable federal law, except where the client's province requires otherwise.
